Terms of Service

These Terms of Service ("Terms") govern your use of the Vestie mobile app, website, and any related services (collectively, the "Services") provided by Vestie, Inc. ("Vestie," "we," "us," or "our"). By using the Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our Services, you agree to comply with and be legally bound by these Terms. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Services.

3. Our Role as an Adviser

Vestie, Inc. is an internet investment adviser registered with the U.S. Securities and Exchange Commission, and we act as a fiduciary required to act in your best interest. We provide investment advice to our clients exclusively through our interactive website and mobile application. Based on the information you supply through the platform - your financial situation, investment objectives, risk tolerance, and time horizon - our software-based model selects and manages a risk-based model portfolio of exchange-traded funds for you on a discretionary, ongoing basis. Our services, fees, and conflicts of interest are described in our Form ADV Part 2A (Brochure) and Form CRS, available through the platform and the SEC's Investment Adviser Public Disclosure website. If anything in these Terms conflicts with our Form ADV, the Form ADV controls.

4. Account Registration

You are responsible for maintaining the security of your account credentials. You agree to provide accurate and complete information when creating an account and to update it as needed.

5. Use of Financial Data

By using our Services, you authorize us to retrieve financial information from your bank accounts and investment accounts through third-party providers (such as Plaid). This information is used to provide investment services as described in these Terms and in our Form ADV.

6. Fees and Charges

Our advisory fee is a flat subscription fee disclosed in our Form ADV Part 2A and Form CRS, billed in advance through the platform to your designated payment method via Stripe with your authorization. We do not deduct advisory fees from your custodial account.

7. Third-Party Services

We rely on third-party vendors (including Plaid, Firebase, Stripe, Alpaca, etc.) to provide parts of our Services. Your use of their services may be subject to additional terms.

8. Risks of Investing

Investing involves risk, including the possible loss of principal. Past performance is not a guarantee of future results. While we act in your best interest, we cannot and do not guarantee any specific investment outcome.

9. Termination

You may close your account and terminate your relationship with us at any time. Upon termination, you may withdraw your assets or transfer them to another brokerage, subject to applicable law and operational requirements. We may suspend or terminate your account if we believe you have violated these Terms.

10. Data Deletion and Retention

You may request deletion of your account and associated data at any time by emailing us at hey@vestie.com. We will process your request in accordance with our Privacy Policy and applicable law.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes. Continued use of the Services after changes constitutes your acceptance.
